Terms and Conditions
PROVISION OF SERVICES BY MASTERTRAINERS SL
This agreement is made between Masterfisiotrainers SL, with Tax Identification Number (CIF) B44612265 and registered address at Calle Santa Elena n7, Málaga, hereinafter referred to as "Master Trainers," and the client, hereinafter referred to as "the client." This PERSONAL TRAINING SERVICES AGREEMENT is governed by the following clauses:
-SUBJECT AND PLACE OF SERVICE PROVISION-
Through this agreement, the parties agree to the provision of personal training and/or group classes in Pilates, yoga, functional training, and/or cross-training by Master Trainers to the client, including, among other things, the preparation of a specific exercise program adapted to the client's physical condition and needs, personalized training, and ongoing sports advice. In addition, Master Trainers will lead and coordinate the group class, selecting safe exercises for participants, should this option be chosen.
The agreed-upon services will be provided exclusively at the MasterTrainers center, located at Calle Santa Elena, 7, Málaga, where the client is registered, as identified by the client on the membership form. MasterTrainers will be responsible for providing all necessary equipment.
-CONTRACT DURATION, NUMBER AND USE OF SESSIONS-
This contract has a minimum duration of one month and includes a total of (indicate number of sessions) on the days and times agreed upon between the personal trainer and the client. The 20-session package is valid for 60 days. For group classes, the duration will depend on the number of sessions included in the membership, at the stipulated times.
Each session must be carried out at the indicated frequency, and any sessions not completed within that timeframe will be invalid. In exceptional cases, duly justified and documented with MasterTrainers, the client may request an extension of the period, which will not exceed 60 days. In any other case, the Client will forfeit the right to any unused sessions. Master Trainers will not issue refunds after 15 days from the signing of this contract.
-SESSION DURATION, RATING, AND CANCELLATION-
Each weekly personal training session will last 30 to 60 minutes, as agreed upon with the trainer. All sessions must begin promptly at the agreed-upon time and will not be extended due to delays caused by the client. In the case of group classes, if more than 15 minutes have passed since the start date and without justification, the client will not be allowed to enter the class, and it will be considered completed.
Sessions must be scheduled weekly and monthly at least 12 hours in advance. Cancellations of scheduled sessions must be made at least 8 hours in advance. Sessions canceled with less than 8 hours' notice without legal justification will be considered completed.
-PAYMENT-
For the services provided, the client will pay Master Trainers the monthly amount of € (chosen membership fee), including applicable VAT.
The first monthly payment is due on the contract start date; subsequent monthly payments are due on the first business day of the following month for group classes; and 30 days later for personal training (the day before the end of the contract month).
Payments can be made by direct debit, automatic renewal with credit card subscription, or cash, the latter incurring an additional €5 fee, according to the terms established in the service contract between the client and Master Trainers.
-CONTRACT RENEWAL AND UPDATE/CHANGE OF COMPENSATION-
This contract is automatically renewed for one-month periods unless terminated by the client at least fifteen (15) days prior to its expiration.
In the event of termination, Master Trainers will cease to collect the corresponding fee for the following period.
Remuneration will be updated annually in January, according to the Harmonised Index of Consumer Prices published by the National Institute of Statistics (INE) in September of the previous year.
-ASSIGNMENT OF CONTRACTUAL POSITION-
The client may not assign any right or obligation under this contract without the written consent of Master Trainers.
-LIABILITY AND GUARANTEES-
Master Trainers is not liable for damages resulting from failure to follow instructions or equipment usage guidelines, nor for force majeure events or actions of third parties.
The trainers and instructors are qualified professionals, although the "Personal Training" certificate does not imply specific knowledge in healthcare areas.
Master Trainers does not guarantee specific progress or results derived from the provision of services.
-MISCELLANEOUS PROVISIONS-
Any changes to this contract must be made in writing and signed by both parties.
The invalidity of one provision will not affect the validity of the others, pursuant to Article 1091 of the Spanish Civil Code.
For matters relating to this contract, the courts of Málaga shall have jurisdiction, with express waiver of any other jurisdiction. The court of the client's domicile being the closest to the relevant court.

Membership-specific terms and conditions
COLLECTIVE CLASSES-TERMS AND CONDITIONS FOR COLLECTIVE CLASSES –-
Between them: Masterfisiotrainers SL, with Tax Identification Number B44612265 and registered address at Calle Santa Elena, M7, Málaga , hereinafter referred to as "Master Trainers", and on the other hand, the client, hereinafter referred to as "client". This TRAINING SERVICES AGREEMENT is established
PERSONNEL, governed by the following clauses :
-OBJECT AND PLACE OF SERVICE PROVISION-
Through this contract, the parties agree to the provision of services of
Guided Pilates, yoga, functional training, and/or Hyrox classes led by Master Trainers for the client, including, among other things, the preparation of a specific exercise program adapted to the client's physical condition and needs, personalized training, and ongoing sports advice. In addition to leading and coordinating the class, selecting safe exercises for the participants.
The agreed services will be provided exclusively at the MasterTrainers center facilities, located at Calle Santa Elena, nº 7, Málaga , where the Client is registered , as identified by the Client on the membership form . MasterTrainers will be responsible for providing all necessary equipment.
-DURATION OF THE CONTRACT, NUMBER AND USE OF THE SESSIONS-
1- This contract has a minimum duration of one month and comprises a total of (indicate number of sessions).
2- The number of sessions will depend on the chosen membership , valid for one month, except for the 20-session voucher, which is valid for 60 days .
3- Sessions must be completed within one month. In exceptional cases, duly justified and documented with Master Trainers, the class may be rescheduled. In any other case, the Client will forfeit the right to the missed sessions. Master Trainers will not issue refunds after 15 days from the signing of this contract.
4-If the client wishes to take any extra classes, they must pay for them as a single session or make a change to their membership .
5-Except for the 20-session voucher, which lasts for 60 days , the period to use the sessions, after which it will be terminated .
-DURATION, RATING AND CANCELLATION OF SESSIONS-
1-Each session will last 45-50 minutes. All sessions must begin promptly at the scheduled time and will not be extended due to delays caused by the client. After 10 minutes, no one will be allowed to enter the class and the class will be considered completed .
2-Classes can be cancelled up to 1 hour before the activity begins. If you do not cancel in time, the credit will be deducted , and the class will be considered completed .
-PAY-
1- For the services provided, the client will pay Master Trainers the amount of € monthly , including the corresponding VAT.
2- The first monthly payment will be made on the start date of the contract, being proportional to the fee; subsequent monthly payments will be made on the first working day of the following month.
3- The fees can be paid by direct debit, card subscription or cash, with or without automatic renewal , the latter having an additional cost of € 5 in ALL MEMBERSHIPS , according to the terms established in the service contract between the client and Master Trainers.
4- When choosing a discount for a campaign, population type, or pre-opening, it applies to all monthly payments for the duration of the contract. If the discount has an expiration date, it will be indicated . Once the membership is canceled , the current price and discount will be lost . **The couple's membership does include a family discount, as long as it's different from the training partner . ** The senior discount applies to those 65+. **The student discount applies with proof of enrollment. Once the member is no longer a student, the fee will revert to the standard rate.** The friend discount is valid for one month only, with a maximum of four family members eligible in the same month. It applies to both the inviter and the invitee. If they sign up at the same time, the discount will be applied to that membership . If one of the family members is already enrolled, the discount will be applied to the next invoice.
-RENEWAL OF THE CONTRACT AND UPDATE / CHANGE OF REMUNERATION-
1- This contract is automatically renewed for periods of one month unless terminated by the client at least fifteen (15) days prior to its expiration. **
2-To withdraw from the contract and subsequent cancellation of membership , you must notify MasterTrainer or unsubscribe in the app, no later than the 25th of each month.
3-In case of termination, Master Trainers will cease to receive the corresponding remuneration for the following period .
4-The remuneration will be updated annually in January, according to the harmonized consumer price index published by the National Institute of Statistics ( INE ) in September of the previous year.
5- In case of cancellation, you lose all rights, discounts and current prices.
-CONTRACTUAL POSITION ASSIGNMENT-
The client may not assign any right or obligation under this contract without the written consent of Master Trainers.
-RESPONSIBILITY AND GUARANTEES-
1- Master Trainers is not responsible for damages resulting from non-compliance with instructions or rules for the use of equipment, nor for cases of force majeure or actions of third parties.
2- The trainers and instructors are qualified professionals, although the "Personal Training" certificate does not imply specific knowledge in health areas .

-VARIOUS PROVISIONS-

3- For matters related to this contract, the court and tribunal of Malaga is competent , with express waiver of any other, the option of the client's domicile being the closest to the corresponding one.
